Pool & Facility Policies 

MEMBERSHIP CODE OF CONDUCT 

The purpose of this document is to define the rules, policies and procedures of the Clearwater Swim Club. The Safety of our Members, Guests and Staff is Clearwater’s top priority and the Club is committed to providing an environment in which all individuals are treated with respect. While on the premises, all Members and their guests are required and expected to abide by the policies set forth below. 

Rules and regulations are subject to change at the discretion of the Board of Trustees. Any updates will be communicated to the entire club via email and/or website. 

General Facility Rules & Procedures 

Members must be responsive to the requests of the managers and lifeguards on duty and follow good safety practices on the Club grounds. See ‘Pool Safety and Etiquette’ section below. 

Fifteen minutes prior to closing time, members will be asked to vacate the swimming pools in order to make sure the pool closing procedures can be conducted properly and on time. 

The pool may be closed for occasional, necessary maintenance, and at the discretion of the manager during inclement weather. On special occasions the pool may be closed to the general membership. Advance notice will always be provided via the Clearwater website, Facebook & Instagram pages and / or direct email. 

Office facilities and the tool garage are for staff personnel only. Unauthorized admission to the office is prohibited. The office phone is available for emergencies and membership use is subject to manager approval. 

Recycling receptacles are commingled (cardboard, glass, aluminum and paper). 

The Club will not be responsible for loss of or damage to the personal property of any member. Please report immediately any losses or damage of personal property to the Club Manager. 

In the event that the Club is required to close the pool due to the failure of either a member or a guest of a member to comply with any of the Club’s rules, the Board may, in its sole discretion, charge the member family $2000.   In the event that the member family fails promptly to pay any such charge, the family’s membership will be suspended and/or terminated at the sole discretion of the Board.  The determination of when such a payment will be due will be determined by the Board, in its sole discretion, based upon the relevant facts and circumstances.

Check-In Policy 

Each family member and/or nanny must check in at the front desk BEFORE entering the pool area. Guests must register at the front desk at that time as well. 

Guest Policies & Fees 

All guests must be accompanied by their host member at all times. No exceptions are granted. A guest may leave the pool premises and re-enter at any time during the same day with their host member with no additional charge. 

Guest Fees are as follows: 

  • Adults or Children over 1 years of age: $10.00/person 

The number of guests permitted is as follows: 

  • Families (Adult Member present) may have up to six (6) guests without prior approval from the management. 

  • Children ages 12 & 13 may bring one (1) guest (age 12 or older). 

  • Members ages 14-18 years old are permitted to bring up to two (2) guests (age 12 or older).

  • Children under age 12 may not sign in guests without an adult present. 

  • Childcare provider/nanny are not allowed to bring adult guests to the pool.

Pool management may require any guest to pass the pool swim test to ensure the safety of the guest and all members. 

Age Policy 

Children under 11 years old will not be permitted within the pool area unless accompanied by an adult or registered nanny. The nanny must be part of the family membership. 

Upon turning 11 years old, a child may be admitted to the Club without an adult member present until 8pm. This privilege is dependent upon the child following club rules and the direction of the pool manager. 

Child Care Provider Policy 

The Club offers the option of an annual child care provider payment of $275. Members that select this option will have unlimited nanny/caregiver privileges at the pool without paying daily guest fees. Once the fee is paid, the nanny/caregiver will need to be pre-registered. A profile will be created under the Members account for the nanny/caregiver and they will be expected to follow all rules and policies of the Club. 

A nanny/caregiver may not sign in adult guests. 

A nanny/caregiver must be attentive to their employer’s children at all times (i.e. must have eyes on the child at all times, must be aware of all club rules, should not be laying out/sunning/sleeping while children are running around the club). 

A non-registered babysitter may not bring children to the pool without the Member being present. A daily guest fee will be charged for the babysitter. 

One exception to this rule is the temporary guest pass when parents are out of town. For a temporary guest pass, a Member must submit an email notification to the Board via board@clearwaterswimclub.com. Standard guest fees will apply for this person. 

Pool Safety & Etiquette 

Proper swimming attire should be worn at all times.

All swimmers must take a shower before entering the main pool. 

No floatation devices, inflated tubes, or toys are allowed in the main pool. The designed “Float Night” is the only exception to this policy. 

Swimmies and diapers are not permitted in the main pool, per state health regulations

In order to be in the main pool children must be FULLY toilet trained. Children who are not toilet trained are not permitted in the main pool – this includes children being held by a parent/adult. 

Please also see the Rule above in the General Facility Rules & Procedures section regarding charges associated with the potential closure of the pool.

There will be no running, pushing, wrestling or causing undue disturbance or hazard in or around the pool area. 

There is no rough housing, tossing of children, swimmers on shoulders at any time in any of the pools. 

Admission will be refused to anyone with skin eruptions, open wounds, coughs, colds, inflamed eyes, infections or wearing bandages. Upon competent medical advice, exceptions may be permitted. 

All changing of diapers must be done in the locker rooms. Changing tables are available in both locker rooms. A family bathroom is also available for member use. 

Footwear must be used in the locker rooms and family bathroom. Children under 6 years old must be accompanied by an adult in the bathrooms. 

Use of the baby pool (pool and fenced area surrounding the baby pool) is limited to children under 6 years of age, accompanying adults and siblings. 

All swimmers must be sober to use the main swimming pool. 

Dive Tank / Deep End Rules 

All swimmers must be 11 years of age or older to use the dive tank or swim in the deep end of the pool with the following exception: 

  • Children 10 years of age and younger may use the dive tank and swim in the deep end of the pool after passing the swim test (two complete laps and tread water for 30 seconds) administered by a pool staff member. Upon passing the swim test, a Clearwater bracelet will be provided to the swimmer, their name will be added to the “pass” list. The swim bracelet must be worn in order to use the dive tank or swim in the deep end of the pool. 

  • A guest 10 years of age and younger must also pass the swim test to use the dive tank or swim in the deep end of the pool. They will be added to the swim test list and be issued a temporary bracelet that they must return prior to leaving. They can pick up the bracelet the next time they visit the pool. 

No goggles are permitted when using the diving board and/or slide. 

Only one swimmer is allowed on the diving board or slide at a time. Once the swimmer has left the diving board/slide, a new swimmer may climb up the stairs but must wait until the previous swimmer has reached the ladder before diving or sliding.

After diving or sliding, all swimmers must swim to the ladder on the same side to exit the pool (no 3 crossing over the dive tank to the other side). Swimmers may not hop out at the wall. 

Swim Lessons 

Group swim lessons will be held during late June and July. Each class will be for one half hour with signups being sent via email. There will be no charge for group lessons. 

Private lessons can be arranged independently with approved Club employees. No one outside approved Club employees may teach private lessons. A fee will be charged for private lessons and paid directly to the lifeguard. 

Food & Beverage Policy 

No food of any kind is allowed on the pool deck or in the main pool (exception to this is the fenced area around the kiddie pool). 

Responsible consumption of alcohol is permitted on the club premises. Paper, plastic or recyclable cups should be used when possible. 

All bottles and cans should be stored in a cooler or other appropriate container. 

No glass containers of any kind are permitted on the pool deck, including the baby pool or any hard surface/paved area throughout the club. 

No kegs, beer balls, or any large alcohol-dispensing apparatus is permitted on the Clearwater premises. 

No public intoxication. 

Grills are provided for member use. It is the responsibility of the member to attend to the grill while it is in use. Members are required to clean the grill and utensils when finished, and turn off the grill. 

Smoking 

Smoking or vaping is not permitted anywhere on Clearwater property. 

Pets 

No pets are permitted within the fenced area of Clearwater. 

Children’s Parties 

Parties are permitted at Clearwater for children of Members only, subject to availability and approval of management. Parties should be scheduled at least two weeks in advance of the party, so that management is informed in advance of all upcoming events in order to staff appropriately. The Member is primarily responsible for ensuring appropriate behavior by all party guests. 

To schedule a party, members must email their request with the requested date/time of the event and approximate number of guests to board@clearwaterswimclub.com. 

All non-member children and children ages 10 and under are required to (i) undergo a swim evaluation by a pool staff member prior to entering the pool, and (ii) listen to a summation of Clearwater rules which will be provided by a pool staff member at the beginning of each party.

There is a fee of $200. Each party is allowed up to 2 hours for up to 20 non-member children. All fees must be paid before or on the day of the party. The host Member will be billed separately for non Member adult guests per the established fee schedule. 

All scheduled children’s parties must conclude by 4:00pm on Fridays. No children’s parties are permitted on the weekends. 

Parties are not permitted on holidays. 

Only one party may take place per two hour time period. 

Lost & Found 

The lost and found, located in front of the garage by the grills, will be cleared every 2nd and 4th Friday of the month. Any items left unclaimed at that time will be donated to a local charity. Please check for missing items before these dates each month. 

Athletics 

Our athletic environment (including swim, dive, tennis and paddle teams), while competitive, must also be safe, positive and conducive to the development of self-esteem, achievement of goals, sportsmanship and fun. Members of the Clearwater Swim Club will conduct themselves at all times in a fair and responsible manner. Members must avoid any and all behavior that affects the Club negatively, whether at home or away. Members of the Clearwater Swim Club will not engage in any activity or behavior that interferes with a competition or which endangers the safety of others. 

Parking & Parking Lot Area 

Members will drive slowly and carefully on the driveway and in parking areas. 

Bicycle riders will use the designated bicycle parking area and will ride carefully with proper consideration for pedestrians. 

For pedestrian safety, there will be no parking of cars in the traffic circle in front of the pool. Cars may not be left unattended in the traffic circle in front of the pool entrance for any amount of time, however short. 

Please be mindful of your parking (i.e. do not take double spaces) and do not park on any of the grass areas unless the lot is completely full. 

No one is permitted to park on or near the bridge. The area must be clear to allow access for emergency vehicles. 

If you need to leave your vehicle overnight, you must get permission from management and the New Providence Police Department must be notified. 

 

Waiver and Release of Liability, Assumption of Risk, and Indemnity Waiver

In consideration of being permitted to use the property, facilities, staff, equipment and services of Clearwater Swim Club (“CSC”), I, for myself, my heirs, personal representatives or assigns, do hereby waive, release, and discharge CSC, its directors, officers, employees, and agents from liability for any and all claims and damages, including those caused by the negligence of CSC, resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in activities, swim team, classes, observation, and use of facilities, premises or equipment. 

Assumption of Risks: Swimming and physical activity, by its very nature, carry with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks range from minor injuries such as scratches, bruises, and sprains to catastrophic injuries resulting in paralysis or death. I know, understand, and appreciate that these and other risks are inherent in the activities made possible by CSC. I hereby assert that my participation in these activities is voluntary, and that I knowingly assume all such risks. 

Indemnification and Hold Harmless: I also agree to indemnify, hold harmless, and defend CSC from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees, which arise out of my use of the property, facilities, staff, equipment or services of CSC, or that arise out of such use by any minor children of which I am the parent or guardian. 

Thank you for your adherence to these rules and protocols. Failure to comply with this code, by a member, member’s child or member’s guest may result in disciplinary action. Such action may result in the member losing the privileges that come with membership in the Clearwater Swim Club, including the opportunity to participate in Club activities up to suspension or permanent expulsion.
